The rules and legal terms that govern your use of TestiLink
These Terms & Conditions ("Terms") govern your access to and use of the services provided by TestiLink ("we", "us", "our"). By accessing or using our website, applications, or services you agree to be bound by these Terms. If you do not agree, do not use the services.
TestiLink provides tools to generate and manage video testimonial requests and related services ("Services"). We may modify, suspend or discontinue all or part of the Services at any time. Some Services may be paid or subject to limitations set out on our website.
You must be at least 18 years old (or the legal age in your jurisdiction) to use the Services. By creating an account you represent and warrant that you meet the eligibility requirements and that the information you provide is accurate and up-to-date.
When you create an account you agree to provide accurate information and keep your credentials secure. You are responsible for all activity occurring under your account. Notify us immediately of any unauthorized use. We are not liable for losses caused by someone else using your account.

You represent that you have all rights and permissions to submit the content and that it does not violate any law or third-party rights.
You must not: use the Services for unlawful activities; infringe intellectual property; upload malicious files; attempt to interfere with or disrupt the Services; access others' data without permission; or circumvent any technical protection. We may suspend or terminate accounts for violations.
All rights, title and interest in the Services (excluding your content) are owned by TestiLink or our licensors. You may not copy, modify, distribute, sell or lease any part of our Services or use our trademarks without permission.
The Services may integrate with third-party platforms and payment processors. Those third parties have their own terms and privacy practices. TestiLink is not responsible for their actions or content.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED ACCESS OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESTILINK (AND ITS OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS AND PARTNERS) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM (OR, IF NONE, INR 1000).
You agree to indemnify and hold harmless TestiLink and its affiliates from any claim, loss, liability, cost or expense (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Services, including content you submit.
We may suspend or terminate your access at any time for breach of these Terms, inactivity, or for any lawful reason. On termination, your right to use the Services ends. We may retain certain data as required by law or for legitimate business purposes.
These Terms are governed by the laws of the jurisdiction where TestiLink is located (replace with your jurisdiction). Any dispute arising out of or related to these Terms will be resolved in the courts located in that jurisdiction unless otherwise agreed in writing.
We may update these Terms from time to time. If we make material changes we will provide notice (for example via email or prominent notice on the site). Continued use after changes indicates acceptance of the updated Terms.
Failure to enforce any provision of these Terms does not constitute a waiver. If any part of these Terms is held invalid, the remaining provisions will continue in full force and effect.
